Studio Toggle Architects (“Studio Toggle“, “we”) respects your privacy and protects the personal data you share with us. This policy explains what we collect, how we use it, and your rights. It is written to comply with the EU General Data Protection Regulation (GDPR) and Portuguese Law 58/2019 supervised by the CNPD; Kuwait CITRA Regulation No. 26 of 2024 and Law 20/2014; and international copyright instruments governing architectural works, including the Berne Convention, the WIPO Copyright Treaty, Kuwait Law 75/2019, and the Portuguese Código do Direito de Autor (Decree-Law 63/85).
Who we are
Studio Toggle is an architecture and design practice with offices in Kuwait (P.O. Box 1938-20002, State of Kuwait — +965 222-00443) and Porto (R. Direita de Francos 943, 4250-193 Porto — +351 223-215-933). For data processed in the EU, our Porto office acts as controller; for data processed in Kuwait, our Salmiya office acts as controller. Data we collect
We collect information you give us — name, organisation, email, phone, postal address, and project brief — and basic website analytics such as IP address, browser, and pages viewed. Recruitment enquiries include the CVs, portfolios, and cover letters you submit. We do not intentionally collect special-category data, and we do not collect personal data from minors.
How we use it
We use personal data to prepare proposals and deliver architectural, interior, and urban design services; to coordinate with consultants, contractors, and authorities; to maintain project and accounting records; to process recruitment; to operate this website; and to meet our legal and professional obligations.
Legal basis
For data subjects in the EEA we rely on Article 6(1) GDPR — performance of contract, legitimate interests, legal obligation, or your consent. For data subjects in Kuwait we rely on your explicit consent under CITRA Regulation No. 26 of 2024, save where another lawful basis such as the performance of a contract applies. Consent may be withdrawn at any time.
Sharing
We share personal data only where necessary and on a need-to-know basis: with project consultants and contractors, service providers (cloud, email, accounting), professional advisers (lawyers, auditors, insurers), and authorities where required by law. We do not sell personal data and we do not share it for third-party marketing.
International transfers
Data may be transferred between our Kuwait and Porto offices to deliver services. Where data originating in the EEA is transferred outside the EEA, we rely on Standard Contractual Clauses or another lawful mechanism under Chapter V GDPR, with appropriate technical and organisational safeguards.
Retention
Enquiries that do not result in a project are deleted within 24 months. Client and project records are kept for the duration of the engagement and for at least 10 years after project completion, in line with professional-indemnity and statute-of-limitation requirements. Unsuccessful recruitment applications are kept for up to 12 months. Accounting records are kept for the periods prescribed by Kuwaiti and Portuguese tax law.
Your rights
Subject to applicable law, you may request access, rectification, erasure, restriction, or portability of your data, object to processing based on legitimate interests, and withdraw consent at any time. Email info@studiotoggle.com — we respond within 30 days. You may also lodge a complaint with the CNPD (cnpd.pt) in Portugal or CITRA (citra.gov.kw) in Kuwait. We would appreciate the chance to address your concerns first.
Cookies
Our website uses cookies strictly necessary to deliver the site and, with your consent, cookies that help us measure audience and performance. You can control cookies through your browser or through the cookie banner where displayed.
Security
We apply access controls, encryption in transit, and staff confidentiality obligations to protect personal data against loss, misuse, and unauthorised access. We will notify the CNPD within 72 hours of a breach affecting EEA data, as required by Article 33 GDPR, and CITRA within the time frame set by Regulation No. 26 of 2024.
Intellectual property
Drawings, renders, models, specifications, and photographs produced by Studio Toggle are protected as architectural and artistic works under the Berne Convention, Kuwait Law No. 75 of 2019, and Portuguese Decree-Law 63/85. Unless a signed engagement letter provides otherwise, Studio Toggle is the author and first owner of copyright in all design materials. The commissioning client receives a licence to use those materials strictly for the permitted purpose of constructing, operating, and maintaining the project; no other use, reproduction, adaptation, or sub-licensing is permitted without our prior written consent.
We assert our moral rights of paternity and integrity, including the right to be identified as the architect or designer in any publication, exhibition, award submission, or promotional use of the work. We retain the right to photograph our completed projects and to reproduce those photographs and project drawings for portfolio, marketing, competition, exhibition, and editorial purposes, subject to any confidentiality specifically agreed with a client. Preliminary concepts, feasibility studies, and competition entries remain our property whether or not the project proceeds to construction. All text, images, and graphics on studiotoggle.com are owned by Studio Toggle or used under licence; any reproduction, redistribution, or framing requires our prior written permission.
Client confidentiality
Information shared by a client in the course of an engagement is treated as confidential and will not be disclosed except to the client’s authorised representatives, to consultants and contractors under equivalent obligations, where disclosure is required by law, or with the client’s prior written consent.
Changes
We may update this policy from time to time. The effective date at the top of this page will always show the current version; where changes are material, we will provide a more prominent notice.
